These Terms of Use (“Terms”) govern your access to and use of MicahSynth (the “App”). By installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1) License
Subject to these Terms, you are granted a personal, limited, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control for your own non-commercial or commercial creative work. MicahSynth and its licensors retain all rights not expressly granted.
2) Acceptable Use
- Do not reverse engineer, decompile, or attempt to derive the source code except to the extent permitted by law.
- Do not circumvent technical protections or modify, distribute, or create derivative works of the App except as expressly allowed.
- Do not use the App to violate any law, infringe IP rights, or distribute malware or harmful content.
- Do not use the App in a way that could damage, disable, or impair services or systems.
3) Intellectual Property
The App and all related content, trademarks, logos, and materials are owned by MicahSynth or its licensors and are protected by intellectual property laws. Using the App does not grant you ownership of any intellectual property rights in the App or its content.
4) Your Output
You retain any rights you may have in the sounds, music, or other output you create using the App. You are responsible for ensuring you have the necessary rights for any materials you incorporate.
5) Privacy
The App does not collect personal data. See the Privacy Policy for details.
6) Third-Party Services & Open Source
The App may include or link to third-party components or libraries governed by their own licenses. Where required, applicable notices and licenses will be provided in-app or on the project website. Third-party sites and services are not controlled by MicahSynth; use them at your own discretion.
7) Updates & Availability
Features may change, and updates may be delivered through your app store. MicahSynth has no obligation to provide updates or to continue making the App available. Certain features may vary by device.
8) Fees
The App is currently offered free of charge. MicahSynth reserves the right to introduce optional paid features or charges in the future with notice through the store listing or within the App.
9) Disclaimer of Warranties
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. YOUR USE OF THE APP IS AT YOUR SOLE RISK.
10) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MICAHSYNTH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL MICAHSYNTH’S TOTAL LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID (IF ANY) FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $5.
11) Termination
MicahSynth may suspend or terminate your access to the App at any time if you violate these Terms or where required by law. Upon termination, you must cease use of the App. Sections that by their nature should survive termination will survive (e.g., IP, warranty disclaimer, liability limits).
12) Export & Sanctions
You agree to comply with applicable export control and sanctions laws. You will not download or use the App in any jurisdiction where such use is prohibited, or for any prohibited purpose.
13) Governing Law
These Terms are governed by the laws of the State of Washington, USA, without regard to its conflict of laws rules. You agree to the exclusive jurisdiction and venue of courts located in King County, Washington, for disputes arising out of these Terms or the App.
14) Changes to These Terms
We may update these Terms to reflect product or legal changes. Material changes will be posted here with an updated effective date. Your continued use of the App after changes become effective constitutes acceptance of the revised Terms.
